These Terms & Conditions (“Terms”) govern the use of services provided by Techesprit (“we,” “our,” or “us”). By engaging with our web development and digital marketing services, you (“Client,” “you”) agree to these Terms. If you do not agree, please do not use our services.

Services Provided

Techesprit delivers professional web development and digital marketing solutions designed to help businesses grow through:

• Custom website design and development.
• Digital marketing campaigns, including advertising and analytics.
• Ongoing customer support.

We aim to provide services with creativity, technical expertise, and measurable results. However, we do not guarantee specific outcomes, as results may vary based on market and external factors.

Client Responsibilities

To ensure the successful delivery of services, you (the Client) agree to:

• Provide Accurate Information: Supply true, complete, and up-to-date details (e.g., business information, content, branding materials) as required for your project.
• Timely Communication: Respond promptly to requests for feedback, approvals, and materials, to avoid delays in project timelines.
• Lawful Use of Services: Agree not to use any website, platform, or campaign developed by Techesprit for illegal, harmful, or unethical activities. This includes but is not limited to fraudulent activities, spreading malware, or distributing prohibited content.
• Third-Party Accounts: Where applicable (e.g., ad platforms, hosting accounts), provide access or authorization needed for us to manage your campaigns or websites.
• Compliance with Policies: Follow all applicable third-party policies (Google Ads, Facebook Ads, hosting providers, etc.) when using our services.

Failure to comply with these responsibilities may result in delays, suspension of services, or termination of the agreement.

Intellectual Property Rights

• Ownership of Work: All websites, code, designs, campaigns, strategies, templates, and other creative or technical deliverables developed by Techesprit remain the sole intellectual property of Techesprit unless explicitly stated otherwise in a written agreement.
• Client License: Upon completion of services and subject to full payment of all agreed fees, Techesprit grants the Client a limited, non-exclusive, non-transferable license to use the deliverables for their business purposes.
• Restrictions: Clients may not copy, resell, redistribute, or otherwise use Techesprit’s deliverables outside of the agreed project scope without prior written consent.
• Right to Withdraw: Techesprit reserves the right to withhold, suspend, or remove deliverables, as well as cut off support, if:
  • The Client engages in intentional misuse of the deliverables,
  • The Client violates agreed payment terms (e.g., failure to pay outstanding amounts), or
  • The Client uses the deliverables for illegal, harmful, or unethical purposes.

This ensures that while Clients benefit from the use of our services, Techesprit retains ownership rights to its work and maintains the ability to protect its intellectual property.

Limitation of Liability

• No Guarantee of Results: While Techesprit applies expertise and proven strategies in web development and digital marketing, we do not guarantee specific business outcomes such as revenue growth, increased traffic, improved search engine rankings, or campaign performance. Results may vary depending on industry, competition, market conditions, and third-party platform changes.
• Third-Party Services: Techesprit may rely on third-party providers such as hosting services, payment processors, ad platforms (e.g., Google Ads, Facebook), and email marketing tools. We are not responsible for downtime, service interruptions, or failures caused by these providers.
• Indirect Damages: Techesprit is not liable for any indirect, incidental, or consequential damages including, but not limited to, loss of profits, data, reputation, or business opportunities arising from the use of our services.
• Maximum Liability: In no case shall Techesprit’s total liability exceed the amount paid by the Client for the specific service giving rise to the claim.

This limitation ensures that Techesprit is not held responsible for issues outside our direct control.

Governing Law & Jurisdiction

• These Terms & Conditions shall be governed by and interpreted in accordance with the laws of Pakistan.
• In the event of a dispute, both parties agree to first attempt to resolve the matter amicably through discussion or mediation.
• If no resolution is reached, the dispute shall be subject to the exclusive jurisdiction of the courts of Pakistan.
